Don't Skip This: Title Insurance Explained

Of everything buyers sign at closing, title insurance is probably the least understood, and the one most likely to get waved off as just another fee. It shouldn't be. Here's what it's actually protecting you from.

When you buy a home, you're not just buying the structure, you're buying clear legal ownership of it. Title insurance protects that ownership against problems from the property's past, things that happened long before you ever knew the house existed. That could be an old lien nobody disclosed, a forged signature somewhere in the chain of ownership, an unresolved boundary dispute, or an heir who shows up later claiming a stake in the property. A title search is done before closing to catch most of these issues, but a search can only find what's actually in the public record, and some problems only surface after the sale.

There are actually two policies involved in most transactions. A lender's policy, which your mortgage company will require, protects the lender's financial interest in the property. An owner's policy, which is optional but strongly recommended, protects you directly, and it's the one that actually has your name on it as the person covered.

Here's the detail people miss: title insurance is a one time cost, paid at closing, that lasts as long as you or your heirs own the property. There's no annual premium, no renewal, nothing to remember to pay again next year. Compared to almost anything else in a real estate transaction, it's a genuinely small cost for protection against a problem that, while rare, can be extremely expensive and stressful to untangle if it happens to you.

I've seen title issues surface on properties that looked completely clean on paper, an old contractor's lien that was never released, a name that was never fully removed from a previous transfer. None of those buyers were at fault, and none of them ended up on the hook, because they had an owner's policy in place.

It's not the most exciting line item on your closing statement, but it's one of the few protections in this entire process that quietly does its job in the background for as long as you own the home.
